Judgment

ORDER The present Writ Petition has been filed seeking to quash the impugned order dated 06.03.2026 passed by the sixth respondent and consequently direct the sixth respondent to approve the School Committee constituted for the period from 01.09.2025 to 30.08.2028, based on the documents and other material records submitted by the petitioner.

2.The learned counsel appearing for the petitioner submitted that the petitioner is running an educational institution in the name and style of Annai Saradamani Primary School and was appointed as its Secretary for the period from 01.09.2025 to 30.08.2028. Pursuant thereto, the petitioner submitted an application before the competent authority seeking approval of his appointment as Secretary. However, the same came to be rejected by the impugned order on the ground that the petitioner's sister, namely, Maheswari, had raised objections claiming ownership of the School on the strength of a Will. The sixth respondent, while rejecting the petitioner's application, also directed the petitioner to rectify the defects pointed out in the impugned order. Aggrieved by the said order, the petitioner has filed the present Writ Petition.

3.The learned counsel for the petitioner further submitted that the petitioner would be satisfied if this Court grants liberty to submit a rectification application, after curing the defects pointed out in the impugned order, within a reasonable time.

4.Considering the limited request made by the learned counsel for the petitioner, without expressing any opinion on the merits of the rival claims, the petitioner is granted liberty to submit a rectification application before the competent authority, after rectifying the defects pointed out in the impugned order, within a period of one (1) week from the date of receipt of a copy of this order.

5.On receipt of such rectification application, the sixth respondent shall consider the same on its own merits and in accordance with law, after affording an opportunity of hearing to all the necessary parties, and pass appropriate orders within a period of eight (8) weeks thereafter.

6.With the above observations and directions, this Writ Petition stands disposed of. No costs. Consequently, connected Miscellaneous Petitions are closed.
