Judgment
O R D E R This Writ Petition has been filed seeking a writ of mandamus forbearing the respondents from laying a road in the petitioner's property comprised in Survey No.30/1A3, Soorappatty Village, Melur Taluk, Madurai District.
¶2Heard Mr. K.S. Kathiravan, learned counsel appearing for the petitioner, and Mr. M. Mahaboob Athiff, learned counsel for State, who takes notice on behalf of the respondents.
¶3By consent of the learned counsel appearing on either side, this Writ Petition is taken up for final disposal at the stage of admission itself.
¶4The learned counsel appearing for the petitioner submitted that the petitioner is the owner of the property comprised in Survey No.30/1A3, Soorappatty Village, Melur Taluk, Madurai District. According to the petitioner, the respondents are attempting to lay a road through the petitioner's property without following the due process of law. Hence, the present writ petition has been filed.
¶5Per contra, the learned counsel for State appearing for the respondents submitted that the respondents are proposing to lay the road only in the Government land and have no intention of laying the road in the petitioner's property. He further submitted that, if the petitioner is aggrieved by any alleged interference with his property or disputes the identity or boundary of the land, the appropriate remedy is to approach the competent Civil Court, and such disputed questions of title cannot be adjudicated in a writ petition under Article 226 of the Constitution of India.
¶6Recording the above submission made by the learned Counsel for State that the respondents have no intention to lay the proposed road in the petitioner's property and that the proposed road would be laid only in the Government land, no further orders are required in this Writ Petition.
¶7It is made clear that, if the petitioner is aggrieved by any action of the respondents affecting his property or if any dispute regarding title, possession or boundary arises, it is always open to the petitioner to work out his remedies before the competent Civil Court in the manner known to law.
¶8With the above observation, this Writ Petition stands disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
