Judgment

O R D E R This Writ Petition has been filed challenging the order passed by the second respondent dated 22.05.2026 in A.No.192 of 2026 and consequently seeking a direction to respondent Nos.1 and 2 to transfer Electricity Service Connection No.07-28-200-714 standing in respect of Door No.261/A, Madasamy Kovil Street, Ward No.5, Rajapalayam Village and Town, Virudhunagar District, in the name of the petitioner.

¶2Heard Mr. K. Sudalaiyandi, learned counsel appearing for the petitioner, and Mr. S. Deenadhayalan, learned Standing Counsel, who takes notice on behalf of the respondents.

¶3By consent of the learned counsel appearing on either side, this Writ Petition is taken up for final disposal at the stage of admission itself.

¶4The learned counsel appearing for the petitioner submitted that the petitioner is the sister-in-law of the third respondent, who is the brother of the petitioner's husband. During the lifetime of the petitioner's husband, he executed a settlement deed dated 13.02.2009 in favour of the petitioner in respect of the property in question. Challenging the said settlement deed, the third respondent instituted O.S.No.77 of 2014 on the file of the Additional District Munsif Court, Srivilliputtur, seeking a declaration that the settlement deed dated 13.02.2009 is null and void. The suit came to be decreed on 20.02.2023.

¶5Aggrieved by the said judgment and decree, the petitioner has preferred A.S.No.26 of 2023 before the Additional District and Sessions Court, Srivilliputtur, and the said appeal is still pending. It is submitted that though no interim order has been granted in the appeal, the electricity service connection has been transferred in the name of the third respondent pursuant to the impugned proceedings and there is an apprehension that the electricity supply to the petitioner's residence may be disconnected.

¶6The learned counsel for the petitioner submitted that, without prejudice to her rights in the pending first appeal, the petitioner is prepared to continue paying the monthly electricity consumption charges regularly and that she would be satisfied if a direction is issued restraining the respondents from disconnecting the electricity supply till the disposal of A.S.No.26 of 2023.

¶7Per contra, Mr. S. Deenadhayalan, learned Senior Counsel appearing for the respondents, submitted that the respondents have no intention of disconnecting the electricity supply so long as the petitioner continues to pay the current consumption charges regularly. He further submitted that the transfer of the electricity service connection in favour of the third respondent shall abide by the result of A.S.No.26 of 2023 pending before the appellate Court.

¶8Recording the above submission made by the learned Senior Counsel appearing for the respondents, this Court directs that the respondents shall not disconnect the electricity supply to Service Connection No.07-28-200-714, provided the petitioner continues to pay the electricity consumption charges regularly and without default, till the disposal of A.S.No.26 of 2023 by the competent appellate Court. It is made clear that the transfer of the electricity service connection in favour of the third respondent shall be subject to the final outcome of A.S.No.26 of 2023. Except for the above direction, this Court is not inclined to interfere with the impugned order dated 22.05.2026 passed by the second respondent.

¶9With the above observations and directions, this Writ Petition stands disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
