Judgment

ORDER The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the respondents to conduct a survey and demarcate the four boundaries of the petitioner's land comprised in Survey No. 2344, situated at Andankovil Village, Manmangalam Taluk, Karur District, based on the petitioner's representation dated 27.06.2026, within such time as may be stipulated by this Court, and consequently directing the fourth respondent to provide necessary police protection while the survey is conducted by respondent Nos. 1 and 2.

¶2The petitioner is claiming right over the property comprised in Survey No.2344 through a registered sale deed vide Document No.11753 of 2022 dated

14.12.2022. According to the petitioner, the petitioner's vendor had earlier executed three powers of attorney and one settlement deed, and the said particulars have been stated in the petitioner's sale deed. The petitioner further contended that the fourth respondent, claiming to be a lessee, is interfering with the petitioner's peaceful possession and enjoyment of the property. Hence, the petitioner is seeking a direction to conduct a survey and demarcate the boundaries of the property.

¶3In view of the above, the first respondent is directed to conduct a survey with the assistance of the second respondent after issuing notice to the petitioner as well as the fourth respondent. If the first respondent requires police protection, the same shall be provided by the third respondent police. It is made clear that the petitioner shall not take the law into his own hands under the guise of the survey proceedings. The petitioner is at liberty to work out his remedies for removal of the encroachment by following the due process of law. The official respondents shall adhere to the following Standard Operating Procedures: • The official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey. • After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction. • If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. The aforesaid procedure shall be strictly followed by the parties. The said exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.

¶4With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
