Judgment

O R D E R Heard Ms.P.Nageshwari, learned Counsel for the Petitioner, Mrs.K.Porkodi, learned Government Pleader, who takes notice for Respondents 1 and 2 and Mr.S.Kumar, who takes notice for the 3rd Respondent.

¶2This Writ Petition has been filed for issuance of Writ of Certiorarified Mandamus, challenging the impugned order passed by the 13, Ponnamaravathy Primary Agricultural Cooperative Credit Society Limited, Puthupatti, Ponnamaravathy Taluk, Pudukottai District, dated 05.05.2025, whereby the petitioner was placed under suspension for a period of three months.

¶3Learned Counsel for the petitioner contended that there was no extension of suspension and, therefore, the petitioner is liable to be reinstated into service by the said Society. However, the said Society has not been impleaded as a respondent to the Writ Petition. In other words, the petitioner, being a salesman and an employee not governed by the Common Cadre Service Rules, cannot maintain the present Writ Petition against the impugned proceedings in the absence of any allegation of violation of any of the provisions of the Tamil Nadu Co-operative Societies Act, 1983, and the Rules made thereunder, as held by the Full Bench of this Court in K.Marappan vs. The Deputy Registrar of Co-operative Societies, Namakkal Circle, Namakkal and another reported in 2006 (4) CTC 689.

¶4Mrs.K.Porkodi, learned Government Pleader appearing for Respondents 1 and 2, placed before this Court a copy of the proceedings dated 06.02.2026 extending the period of suspension of the petitioner by a further period of 90 days.

¶5Even the said period of 90 days lapsed as early as on

20.05.2026. If that be the case, there is no order of suspension in force as on date in the eye of law. Be that as it may, as the Full Bench of this Court has held that no Writ Petition can be entertained against a Co-operative Society, the question of entertaining the present Writ Petition as against an order passed by the said Society does not arise. However, the petitioner has also got an alternative remedy under Section 153 of the Tamil Nadu Co-operative Societies Act, 1983, before the Joint Registrar of Co-operative Societies, Pudukkottai District.

¶6In the light of the above, the Writ Petition is disposed of, granting liberty to the petitioner to file a revision petition before the Joint Registrar of Co-operative Societies, Pudukkottai, against the impugned suspension order dated 05.05.2025 and the order dated

06.02.2026, and also to seek reinstatement into service, within a period of four weeks from the date of receipt of a copy of this order. On filing such revision by the petitioner, the Joint Registrar of Co-operative Societies shall take the same on file and pass appropriate orders thereon, without reference to limitation, as expeditiously as possible and, at any rate, within a period of six weeks therefrom. The petitioner is also at liberty to ventilate her grievance regarding the non-payment of subsistence allowance for the past six months in the said revision petition. There shall be no order as to costs. Consequently, the connected miscellaneous petitions stand closed.
