...Petitioner

Vs State of Tamil Nadu rep. by The Inspector of Police, Koodankulam Police Station, Tirunelveli District. (Crime No.639 of 2026)

...Respondent/Complainant

For Petitioner : Mr.A.Ravikumar

Advocate

For Respondent : Mr.N.Balasubramanian Counsel for State of TN (Crl. Side) PETITION FOR BAIL Under Sec.483 of BNSS PRAYER :- For Bail in Cr.No. 639 of 2026 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner / Accused, who was arrested and remanded to judicial custody on 15.06.2026, for the offences punishable under Sections 126(2), 296(b), 75 and 351 (2) of BNS, in Crime No.639 of 2026 on the file of the respondent police, seeks bail.

¶2The case of the prosecution is that the petitioner had been continuously stalking the victim, who is a divorcee, and demanding sexual favours from her. Since the victim objected to his conduct, the petitioner allegedly threatened her with dire consequences. Based on the complaint, a case was registered, and the petitioner was arrested. After being released on bail, the petitioner allegedly continued to harass and threaten the victim. Hence, the present case was registered, and the petitioner was arrested.

¶3The learned counsel appearing for the petitioner submitted that the petitioner is innocent, has been falsely implicated in the case, and has not committed any offence as alleged by the prosecution. He further submitted that the petitioner has been in judicial custody since 15.06.2026 and is ready to co-operate with the investigation. According to him, the present case has been registered on false allegations. Hence, he prayed for grant of bail to the petitioner.

¶4The learned Government Advocate (Criminal Side) appearing for the State reiterated the prosecution case and submitted that the petitioner is involved in eight previous criminal cases. He further submitted that the petitioner was arrested in the present case on 15.06.2026. Hence, he strongly opposed the grant of bail to the petitioner.

¶5This Court heard the submissions made on either side and perused the materials available on record.

¶6Considering the fact that the petitioner was earlier arrested in Crime No.545 of 2025 and, after being released on bail, allegedly continued to harass and stalk the victim, the present case came to be registered. The investigation is still in progress. In such circumstances, this Court is not inclined to grant bail to the petitioner at this stage.

¶7Accordingly, this Criminal Original Petition stands dismissed.
