Judgment
ORDER The present Writ Petition has been filed seeking issuance of a direction to the 2nd and 3rd respondents to conduct a survey, demarcate the petitioner's property by fixing boundary stones with adequate police protection, effect subdivision, and issue a separate patta based on the petitioner's representation dated 10.06.2026, within a time frame to be fixed by this Court.
¶2Originally, the property belonged to the petitioner's maternal grandfather, late Angama Naicker, and maternal grandmother, late Ponnammal. The petitioner's grandfather died on 19.04.2005 and the grandmother died on 26.12.2007. Thereafter, the property devolved upon their four daughters, namely, Angammal, Rajammal, Adhilakshmi and Saraswathi, who became the joint owners of the property under Patta No. 3194. The petitioner's mother, Saraswathi, executed a Settlement Deed dated 30.09.2005, registered as Document No.2861 of 2025, settling her undivided 1/4th share in favour of the petitioner. Consequently, the petitioner's name was also included in Joint Patta No.3194.
¶3The learned counsel for the petitioner submitted that the petitioner seeks consideration of the representation. However, it is seen that the petitioner has not submitted an online application for conducting a survey of the property.
¶4Therefore, the petitioner is directed to submit an online application within a period of four (4) weeks from the date of receipt of a copy of this order. On such application being submitted, the 2nd respondent / Tahsildar shall consider the same and conduct a survey of the property after issuing notice to the petitioner, the petitioner's mother, and the other siblings of the petitioner's mother, who are the co-sharers in the property, within a period of eight (8) weeks thereafter. If necessary, the 5th respondent shall provide adequate police protection to facilitate the survey. In the event the petitioner seeks to erect boundary stones, the same shall be carried out at the petitioner's own cost. The Official Respondents shall also adhere to the following Standard Operating Procedures: a) The Official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey. b) After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction. c) If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. The aforesaid procedure shall be strictly followed by all the parties concerned.
¶5With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
