¶2The allegation against the petitioner is that the petitioner herein is the relative of the victim girl aged about 16 years and developed a relationship and subsequently committed aggravated penetrative sexual assault, which resulted in pregnancy. Hence, the case has been registered and the petitioner has been arrested.

¶3The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he was falsely implicated in this case and he has not committed any offence as alleged by the prosecution. The learned counsel for the petitioner would submit that the petitioner is a close relative of the defacto complainant and that there were discussions regarding their marriage. He would further submit that the relationship between the petitioner and the victim was a adolescent love affair and the relationship was consensual. He is in custody from 25.04.2026 and ready to abide any condition imposed by this Court. Hence, he prayed bail for the petitioner.

¶4The learned Counsel appearing for the State (Crl. Side) reiterated the prosecution case by relying upon the statement of the victim girl recorded under Section 183(5) of BNS. Investigation in this case is concluded and awaiting filing of the final report. Hence, he prays to dismiss this application.

¶5This Court heard both sides and perused the materials available on records including the statement of the victim girl recorded under Section 183(5) of BNS.

¶6In the statement of the victim girl, it is stated that the family of the petitioner and the victim were close relatives and that there were negotiations between the families for conducting the marriage, which could not be concluded due to the under age of the victim. Further, it is not stated that the petitioner had forcibly committed aggravated penetrative sexual assault. However, considering the other allegations made by the victim girl, the facts and circumstances of the case, and the period of incarceration undergone by the petitioner, this Court is inclined to grant bail to the petitioner, subject to certain conditions.
