BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT Dated : 10/07/2026 CORAM THE HONOURABLE MR. JUSTICE K. RAJASEKAR Murugeshwari ... Petitioner/Accused No.11 Vs State of Tamilnadu Rep by, The Inspector of Police, Vilakkuthoon Police Station, Madurai City, Madurai District, Crime No.141/2026. ... Respondent/Complainant PRAYER :-

For Bail in Crime No.141/2026 on the file of the respondent police For Petitioner : Ajithkumar M, Advocate. For Respondent : Mr.N.Balasubramanian, Counsel For State of TN (Crl.Side) ORDER : The Court made the following order :- The petitioners / Accused, who were arrested and remanded to judicial custody on 31.05.2026, for the offences punishable under Sections 191(2), 191(3), 103(1), 61(2), 49 and 3(5) of BNS , in Crime No.141 of 2026 on the file of the respondent police, seek bail.

¶2The allegation against the petitioner is that the petitioner herein is ranked as A11 in this case, and during the event of the Chithirai Festival, there was a quarrel between the defacto complaint and the petitioner's family members. Due to that motive, on 24.05.2026, while the deceased was walking near the parking area of the temple, the accused attacked the deceased with a knife and committed murder. Hence, the present complaint has been registered.

¶3The learned counsel appearing for the petitioner would submit that the petitioner is innocent and since she has also been a family member, she was falsely implicated in this case and she has not committed any offence as alleged by the prosecution. He further submitted that the petitioner herein ranked as A11 and the petitioner is in custody from 31.05.2026 and ready to abide any condition imposed by this Court. Hence, he prayed bail for the petitioner.

¶4The learned counsel appearing for the State reiterated the prosecution case and reported that there are totally 11 accused in this case and all the accused were arrested and the petitioner is ranked as A11. The allegation against the petitioner is that she instigated the other accused to commit murder and also she gave a two wheeler for the purpose of attacking the deceased. Hence, he opposed to grant bail to the petitioner.

¶5This Court heard both sides and perused the materials available on record.

¶6It is stated that the petitioner has also actively participated in the conspiracy and also handed over the two-wheeler for the purpose of committing murder. However, the records shows that she has not participated in the conspiracy or in any other activity and hence, the petitioner is entitled to bail.

7.Accordingly, I am inclined to grant bail to the petitioner subject to certain conditions. [a] Accordingly, the petitioner is ordered to be released on bail on condition to execute a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Madurai, Madurai District, and on further conditions that: [b] the petitioner shall stay at Trichy and report before the Principal District and Sessions Court, Trichy, daily at 10.30 a.m., until further orders; [c] the petitioner shall not commit any offence similar to the offence of which he/she is accused, or suspected, or of the commission of which he/she is suspected; [d] the petitioner shall not abscond either during investigation or trial; [e] the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such facts to the Court or to any police officer or tamper with the evidence; [f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 51730]. [g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
