Judgment

ORDER (Order of the Court was made by A.D.JAGADISH CHANDIRA,J.) This Writ Petition has been filed for issuance of a Writ of Mandamus, directing the third respondent to grant 28 days of ordinary leave without Police escort to the petitioner, who is a life convict, presently serving sentence at Central Prison, Madurai by considering the petitioner's representation dated 15.06.2026.

¶2When the matter was taken up for hearing today, the learned Counsel for the State of TN (Crl.Side) appearing for the respondents produced a copy of the proceedings of the second respondent, dated

20.07.2026. On going through the same, it is clear that ordinary leave has been granted for 28 days to the convict with Police escort.

¶3The learned counsel for the petitioner submitted that on earlier occasions, the convict was granted emergency leave. The learned counsel further submitted that ordinary leave has been sought in order to make arrangements to the petitioner's daughter marriage and to take care of the petitioner's wife, who has been referred to undergo surgery. Therefore, it was submitted that the condition imposed by providing for escort may be modified.

¶4Taking into consideration the facts and circumstances and considering the reason, for which, the ordinary leave has been sought and also taking note of the fact that the convict was earlier granted emergency leave and that the convict complied with the conditions and no untoward took place, we are inclined to modify the condition imposed by the third respondent by directing the convict to go on ordinary leave without Police escort. However, the convict shall report before the 5th respondent daily at

6.30 p.m. during the entire period of ordinary leave.

¶5This Writ Petition (Criminal) is disposed of with the above directions. No costs. (A.D.J.C.,J.,) (R.P.,J.,)
