Judgment

ORDER Seeking to direct the 1st respondent to consider the representation of the petitioner dated 18.05.2026, this writ petition is filed.

¶2By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.

¶3The learned counsel for the petitioner submitted that while the petitioner was working as Senior Manager at Indian Overseas Bank, Kottayur Branch, a physical assault took place inside the branch premises on 21.04.2022. Pursuant to which, F.I.R was registered and culminated in filing a charge sheet in C.C.No.1902 of 2022 on the file of the learned Judicial Magistrate, Karaikudi. The same is pending trial. The prime and most material evidence of the case is the CCTV footage of the bank premises. Hence, seeking to collect and submit the CCTV footage in the trial of C.C.No.1902 of 2022 on the file of the learned Judicial Magistrate, Karaikudi, the petitioner has sent a representation on 18.05.2026 to the 1st respondent. Since the same is not considered, this writ petition is filed.

¶4Heard the learned counsel on either side and carefully perused the materials available on record.

¶5It is needless to point out that whenever a representation of this nature is made to a Statutory Authority, there is a duty cast upon the respondent to consider the same on its own merits and pass appropriate orders in one way or other instead of keeping the same pending indefinitely. As such, non-consideration of the representation made by the Statutory Authority would amount to dereliction of duty and hence, this Court will be justified in invoking the extraordinary powers under Article 226 of the Constitution of India.

¶6Without going into the merits of the case, this Court directs the respondents to consider the petitioner's representation, dated 18.05.2026 and pass appropriate orders within a period of four (4) weeks from the date of receipt of a copy of this order.

¶7With the above directions, this Writ Petition stands disposed of.
