Judgment
O R D E R [Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] Challenging the order dated 05.05.2026 passed by the 3rd respondent rejecting the request of the convict prisoner to grant leave, this writ petition is filed to quash the same with a consequential direction to grant 15 days leave to the convict prisoner on humanitarian grounds to take care of his ill father.
¶2Perusal of the impugned order shows that the request of the convict prisoner has been rejected on two grounds. One is that the convict prisoner has got one pending case in Crime No.161 of 2018 on the file of Thalaiyuthu Police Station for the offences under Sections 294(b), 506(ii), 353, 120(b), 100, 34 of IPC read with Section 4 of TNPPD Act, pending before the Chief Judicial Magistrate Court, Tirunelveli and therefore, as per Rule 35 of the Tamil Nadu Suspension of Sentence Rules 1982, the convict prisoner is not entitled to leave. The second reason cited in the impugned order is that for availing leave, the convict prisoner should have completed three years from the date of Page No.2 of 5 incarceration, whereas, he has completed 1 year and 6 months of incarceration only as on 28.04.2026 and therefore, he is not entitled to avail leave in view of Rule 22(1)(c) of the Tamil Nadu Suspension of Sentence Rules 1982.
¶3In view of the abovesaid rule cited in the impugned order, we do not find any merits in this writ petition.
¶4Accordingly, this Writ Petition (Criminal) stands dismissed. [A.D.J.C., J.] [R.P., J.]
