Judgment

ORDER This Writ Petition has been filed seeking a direction to the first respondent not to register the disputed Settlement Deed dated 12.01.2026 executed in favour of the respondents 2 and 3, to the exclusion of the petitioner's other daughters. The respondents 2 and 3 are the daughters of the petitioner.

¶2It is the case of the petitioner that the fourth respondent, by exercising coercion, obtained a Power of Attorney from the petitioner and thereafter sought to register the Settlement Deed dated 12.01.2026. It is submitted that when the document was initially presented for registration, the first respondent refused registration by issuing Refusal Check Slip No.RFL/Natham/2/2026, dated 12.01.2026.

¶3According to the petitioner, in view of the refusal of registration, he was under the bona fide impression that the interests of his other daughters stood protected and that the Settlement Deed, which is alleged to have been obtained by the fourth respondent under duress, would not be registered. ¶4It is further submitted that, by relying upon the Power of Attorney allegedly executed by the petitioner, the contents of which are reportedly not available with him, the fourth respondent approached this Court in W.P.(MD)No.7060 of 2026 and has obtained a direction for registration of the Settlement Deed. It is, therefore, contended that the proposed registration of the Settlement Deed would be contrary to the wishes and intention of the petitioner.

¶5The relief sought for in the present Writ Petition cannot be granted. However, having regard to the advanced age of the petitioner and taking into consideration the submissions made by the learned counsel appearing for the petitioner, liberty is given to the petitioner to seek revision of the order dated 16.06.2026 passed in W.P.(MD)No.7060 of 2026, within a period of four weeks from today.

¶6Till such period, the first respondent shall not register any document pertaining to the property comprised in Survey No.57, situated at Velampatti Village, Natham Taluk, Dindigul District. It is made clear that the aforesaid interim protection shall remain in force only for the said period of four weeks from today, and if the petitioner fails to initiate Page No. 3 of 5 appropriate proceedings within the said period, this interim protection shall automatically stand vacated without any further reference to this Court.

¶7The Writ Petition stands disposed of accordingly. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed. NCC : Yes / No
