Judgment

ORDER This Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the respondents to revise the estimate and allocate additional funds and also extend the period for completion of works for the tender process under MGSMT 2025-26 and savings fund NABARD Scheme 2025-26, by considering the petitioners' representation dated 01.04.2026 and 08.07.2026 at once.

2.Heard Mr.P.Ganapathi Subramanian, learned counsel appearing for the petitioner and Mr.M.Mahaboob Athiff, learned Counsel for the State, who accepts notice on behalf of the respondents 1 to 3.

3.By consent of both parties, the Writ Petition is taken up for final disposal at the stage of admission itself.

4.The learned counsel appearing for the petitioners submitted that the petitioners are contractors who have participated in the tender process relating to the works under MGSMT 2025-26 and Savings Fund NABARD Scheme 2025-26. Pursuant to the tender proceedings, the petitioners have undertaken the execution of the respective works. It is submitted that, during the course of execution, certain practical difficulties have arisen, including escalation in the cost of materials and the need for revision of the existing estimates. In view of the same, the petitioners submitted representations dated 01.04.2026 and 08.07.2026 before the respondents seeking revision of the estimates, allocation of additional funds and extension of the period for completion of the works. However, since no action has been taken on the said representations till date, the petitioners have filed the present writ petition.

¶5The learned counsel further submitted that it would suffice if this Court issues a direction to the third respondent to consider the petitioners' representations dated 01.04.2026 and 08.07.2026 and pass appropriate orders thereon within a time frame to be fixed by this Court.

¶6Considering the above facts and circumstances of the case and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the third respondent, to consider the representations of the petitioners dated 01.04.2026 and 08.07.2026 and pass appropriate orders on merits and in accordance with law. Such exercise shall be completed as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order. No costs. Consequently, the connected miscellaneous petition is closed.
