Judgment

ORDER This petition has been filed challenging clause 10 of the impugned proceedings of the second respondent dated 28.06.2026 vide Na.Ka.No. 103/Ka.Thu.Ka(Ko)/2026 and quash the same as arbitrary and discrimination and consequently directing the respondents to allow all two wheelers from Thirunelveli and Thoothukudi to participate in the 316th Guru Pooja of Maveeran Alagumuthukone, which is scheduled to be conducted on 11.07.2026 at Kattalankulam Village, Nalattinputhur, Kovilpatti.

¶2The learned counsel appearing for the petitioner submitted that grand arrangements have been made for the conduct of the 316th Guru Pooja of Maveeran Alagumuthukone on 11.07.2026. However, Clause 10 of the impugned proceedings issued by the second respondent has caused great difficulty to the organisers, as it restricts the participants from reaching the venue on two-wheelers. According to the learned counsel, such a restriction would cause undue hardship to the devotees, followers, and participants intending to attend the function. It was therefore prayed that this Court may permit the organisers, devotees, and participants to reach Kattalangulam, the birthplace of Maveeran Alagumuthukone, on two-wheelers for the purpose of participating in the Guru Pooja.

¶3The learned Government Advocate appearing for the respondent police strongly opposed the said request and submitted that Clause 10 of the impugned proceedings is necessary in the interest of maintaining public order and safety. According to the learned Government Advocate, during the Guru Pooja celebrations in previous years, several youngsters had indulged in dangerous acts such as wheeling and rash racing on two-wheelers, thereby posing a serious threat to public safety. In support of the said submission, the learned Government Advocate produced before this Court a video recording of the Guru Pooja celebrations held in the earlier years depicting such incidents.

¶4Heard the learned counsel on either sides and carefully perused the materials placed before this Court.

¶5A careful perusal of the video would make it clear that the submission of the learned Government Advocate is not incorrect. In view of the same, Clause 10 of the impugned proceedings passed by the second respondent in Na.Ka.No.103/Ka.Thu.Ka(Ko)/2026, dated 28.06.2026, is hereby set aside, with a strict direction to the organisers to ensure that none of the participants indulges in wheeling, racing, or any other dangerous stunt while riding two-wheelers. If any of the participants indulges in wheeling, racing, or any other dangerous activity while riding a two-wheeler, the respondent police are at liberty to take criminal action against such person on the spot, and the miscreants can be arrested on the spot.

¶6It is further made clear that the organisers and the participants shall strictly adhere to all the other conditions stipulated in the proceedings passed by the second respondent in Na.Ka.No.103/Ka.Thu.Ka(Ko)/2026, dated

28.06.2026.

¶7With the above directions, this writ petition stands disposed of. Consequently, connected miscellaneous petition is closed.
