Judgment
ORDER This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to dispose of the statutory appeal preferred by the fifth respondent, pending in File No.9722099/2025, within a time frame to be fixed by this Court.
2.By consent of the learned counsel appearing for the petitioner and the learned Counsel for Government of Tamil Nadu, the Writ Petition is taken up for final disposal at the stage of admission itself.
3.Since no adverse order is proposed to be passed against the fifth respondent, notice to the fifth respondent is dispensed with.
¶4The learned counsel appearing for the petitioner submitted that the petitioner is an interested party in the proceedings arising out of the statutory appeal preferred by the fifth respondent, which is pending before the first respondent in File No.9722099/2025. Despite the appeal having been pending for a considerable period, the same has not yet been disposed of. It is submitted that the continued pendency of the appeal has caused prejudice to the petitioner. Hence, the petitioner has approached this Court seeking a direction to the first respondent to dispose of the statutory appeal within a time frame to be fixed by this Court.
5.The learned counsel for the petitioner further submitted that the petitioner would be satisfied if this Court issues a direction to the first respondent to consider and dispose of the statutory appeal, after affording an opportunity of hearing to all the necessary parties, within a time frame to be fixed by this Court.
6.Having regard to the limited prayer sought for by the petitioner, and without expressing any opinion on the merits of the rival claims, this Writ Petition is disposed of with a direction to the first respondent to consider and dispose of the statutory appeal pending in File No.9722099/2025, after affording an opportunity of hearing to the petitioner, the fifth respondent and all other necessary or interested parties, if any, and thereafter pass appropriate orders on merits and in accordance with law. Such exercise shall be completed as expeditiously as possible, preferably within a period of twelve (12) weeks from the date of receipt of a copy of this order, if the appeal has not already been disposed of. There shall be no order as to costs.
