Judgment
ORDER Seeking to direct the respondents 1 to 5 to ensure that the petitioner and his men are permitted to conduct the customary goat sacrifice, offering of Pongal, worship special poojas and Aadi Padayal to the deity of Arulmigu Edaiyakaruppar Temple situated at Kulavaipatti Village, Illuppur Taluk, Pudukkottai District on any appropriate day during the Tamil Month of Aadi, by considering the petitioner's representation dated 09.07.2026, this writ petition is filed.
¶2Since no adverse order is passed against the private respondents, notice to the private respondents is dispensed with.
¶3The learned counsel for the petitioner submitted that the private respondents are preventing the petitioner from offering Pongal, goat sacrifice, worship and conduct special poojas in Arulmigu Edaiyakaruppar Temple and sought the indulgence of this Court.
¶4The learned Government Advocate (Civil side) submitted that the temple is not under the control of Hindu Religious and Charitable Endowments (HR & CE) Department. However, dispute is pending before the Joint Commissioner, HR & CE, Pudukkottai filed by the petitioner. Pending the same, the petitioner has come before this Court.
¶5The learned Government Advocate (Crimial side) submitted that with regard to the complaint received from the petitioner, C.S.R has been issued.
¶6Heard the learned counsels on either side and carefully perused the materials available on record.
¶7The 6th respondent police is directed to put the petitioner as well as the respondents 7 to 9 on notice under Section 64 BNSS and sensitize the respondents 7 to 9 that they should not prevent the petitioner and their men from conducting goat sacrifice, offering Pongal, worship special poojas and Aadi Padayal to the deity of Arulmigu Edaiyakaruppar Temple situated at Kulavaipatti Village, Illuppur Taluk, Pudukkottai District, and to facilitate the participation of the villagers without preventing anyone. It is made clear that none of the parties should claim any first honour at the time of the festival. It is also made clear that the petitioner also should not prevent the private respondents from participating in the above events.
¶8With the above directions, this Writ Petition stands disposed of.
