Thiruchendur Arulmigu v. Executive Officer

ORDER The Civil Revision Petition is filed for a direction to direct the Subordinate Judge, Tiruchendur, to dispose the suit in O.S.No.151 of 2017 on merits within the time limit stipulated by this Court.

2.Heard the learned counsel appearing for the petitioners and also perused the materials available on record.

3.According to the petitioners, they filed a suit in O.S.No.23 of 2013 before the Sub-Court, Thoothukudi, for the relief of denominated community and to declare the right to perform Pooja, religious, services, obligation, rituals and Kaingariyam etc., in Arulmigu Subramaniasamy Koil, Tiruchendur and also permanent injunction. Thereafter, the said suit was transferred before the Sub-Court, Tiruchendur and re-numbered as O.S.No. 151 of 2017 and the same is pending without any progress. Hence, the present civil revision petition is filed.

4.The learned counsel appearing for the petitioners would submit that originally the suit was filed in the year 2013 and the same is pending for more than 10 years. Even the respondents had filed a written statement on

29.01.2014, the Court below is adjourning the matter without any valid reason. Hence, he prays for speedy disposal.

5.Considering the facts and circumstances of the case, this Court directs the Subordinate Judge, Tiruchendur, to dispose the suit in O.S.No. 151 of 2017 on merits and in accordance with law, without giving further unnecessary adjournments, as expeditiously as possible, after affording opportunity to the respective parties to put forth their contentions, within a period of six months from the date of receipt of a copy of this order.

6.With the above direction, this Civil Revision Petition is disposed of. No costs.
