Judgment

ORDER

This writ petition has been filed seeking a writ of mandamus directing the second respondent to grant promotion to the petitioner to the post of Assistant Manager based on his original seniority by considering her representation dated 02.07.2026.

2.An objection is raised with regard to the maintainability of the writ petition as the second respondent is only a Society registered under the provisions of Tamil Nadu Co-operative Societies Act, 1983.

¶3In the light of the decision of the Full Bench of this Court reported in 2000(4)CTC 689 in K.Marappan vs. The Deputy Registrar of Co-Operative Societies, the writ petition against Co-operative Society is not maintainable in the absence of allegation of violation of any statutory provision or the Rules made thereunder.

¶4In the light of the above, this Court is not inclined to entertain this writ petition for the present. However, it is also brought to the notice of this Court that the petitioner has already submitted a representation before the first respondent on 02.07.2026 that is before approaching this Court. If that be the case, the proper remedy for the petitioner is also under Section 153 of the Tamil Nadu Co-operative Societies Act, 1983, before the first respondent. As the petitioner has already submitted a representation on 02.07.2026 and the same is pending before the first respondent, this Court is of the considered view that it would be appropriate to relegate the petitioner to approach the first respondent by filing a revision petition seeking resolution of the grievance, which is sought to be ventilated in the present writ petition.

¶5Accordingly, this writ petition is disposed of permitting the petitioner to file a revision petition before the first respondent under Section 153 of the Tamil Nadu Co-operative Socities Act, 1983 within a period of four weeks from the date of receipt of a copy of this order and on filing such revision petition by the petitioner, the first respondent shall take the same on record and dispose of the same on merits without any reference to the period of limitation as expeditiously as possible, at any rate, within a period of two months from the date of filing of the revision petition by the petitioner. No costs.
