Judgment

ORDER This Writ Petition is taken up for final hearing at the time of admission with the consent of the learned counsel for the petitioner, learned Counsel for State of TN for the respondents 1 and 3 and the learned Government Advocate (Crl.Side) for the second respondent.

¶2The petitioner is before this Court against the impugned order passed by the first respondent/District Collector placing certain restrictions on the movement of mineral-transporting vehicles from Tamil Nadu to Kerala via Tuticorin, Tirunelveli and Kanyakumari.

¶3The order impugned is a generic order, which was a subject matter to challenge before this Court in W.P.(MD) No.14168 of 2026 filed by one Libin Poonuswamy Leela against the National Highways Authority of India (NHAI) and others. This Court, by its order dated 13.05.2026, had quashed the notice issued by the first respondent herein in the Writ Petition, holding that the mandatory requirement under Section 115 of the Motor Vehicles Act, 1988, has not been complied with.

¶4Today, when the matter is taken up for hearing, the learned Counsel for State of TN for the respondents 1 and 3 has produced a copy of the Gazette Notification dated 24.06.2026 in Na.Ka.No.231/PuMaSu/2025. The said notification has been issued in compliance with Section 115 of the Motor Vehicles Act, 1988 to supplement the impugned order. Therefore, this Writ Petition has been rendered infructuous in the light of the subsequent development.

¶5Therefore, this Writ Petition is dismissed as infructuous. However, liberty is given to the petitioner to challenge the aforesaid Government Notification. No costs. Consequently, connected miscellaneous petitions are closed. Index : Yes / No
