Judgment
O R D E R This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the second respondent to conduct the enquiry based on the petitioner's representation dated 17.08.2023 under the provisions of the Maintenance and Welfare of the Parent and Senior Citizen Act, 2007 in accordance with law.
¶2Heard the learned counsel for the parties. Since no adverse order is going to be passed, notice to the respondents 4 and 5 is dispensed with.
¶3Though the petitioner executed a registered sale deed in favour of respondents 4 and 5, who are his sons, they failed and refused to maintain the petitioner. Aggrieved by the same, the petitioner submitted a representation dated
17.08.2023 before the official respondents seeking appropriate relief under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. Since no orders have been been passed on the said representation till date, the petitioner has approached this Court by filing the present writ petition.
¶4The learned counsel further submitted that it would suffice if this Court issues a direction to the official respondents to consider the petitioner's representation dated 17.08.2023 and pass appropriate orders thereon within a time frame to be fixed by this Court.
¶5Considering the above facts and circumstances of the case and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to respondents 1 to 3 to consider the petitioner's representation dated 17.08.2023 and pass appropriate orders on merits and in accordance with law, after affording an opportunity of hearing to the petitioner as well as the respondents 4 and 5. Such exercise shall be completed as expeditiously as possible, preferably within a period of four (4) weeks from the date of receipt of a copy of this order. No costs.
