Judgment

O R D E R Heard Mr.J.Lawrance, learned Counsel for the Petitioner and Mr.C.Jeganathan, learned Counsel for Government of Tamil Nadu, who takes notice for Respondents.

¶2This Writ Petition has been filed for issuance of Writ of Mandamus, directing the Respondents to continue the grant of incentive increment for the Petitioner M.Sc., (Yoga) Higher qualification and to wave the recovery of incentive increment amount which is already paid to the Petitioner from her salary by considering the G.O.Ms.No.286 Finance (Pension) Department dated 28.08.2018.

¶3The petitioner has filed this Writ Petition raising an apprehension that the respondents may withdraw the incentive increment that was awarded to her for having acquired an M.Sc.

(Yoga) degree, which the petitioner has been drawing since the year 2016. The petitioner is on the verge of retirement, which is due on

31.07.2026.

¶4According to the learned Counsel for the petitioner, the petitioner was orally asked to repay the entire amount received by her towards the incentive increment that was granted in her favour in the year 2016. However, there is absolutely no material before this Court to accept the said contention. The petitioner appears to have approached this Court merely on the basis of an apprehension. Therefore, this Court is not inclined to entertain the Writ Petition at this stage. However, if the respondents intend to effect any recovery or withdraw the incentive increment that was awarded to the petitioner, they may do so only by following due process of law and after putting the petitioner on notice and in accordance with law.

¶5In view of the above, this Writ Petition is disposed of. There shall be no order as to costs.
