Judgment

ORDER The writ petition is disposed of after hearing the learned counsel for the petitioner and the learned Standing Counsel for the respondents.

¶2It appears that the tenure of the previous elected body came to an end on 08.01.2026. In this regard, the petitioner submitted a representation dated 30.06.2026 to the respondents 1 and 2 seeking to conduct elections to the Vilanthakandam Muhaiyadheen Andavar Pallivasal Waqf (G.S. No. 45/TNJ).

¶3There is no scope for directing the Waqf Board to conduct the elections for the said Waqf, as the conduct of elections is an internal matter. If the elections are not held in accordance with the bylaws, the remedy available to the Waqf Board is to assume direct management under Section 65 of the Waqf Act, 1995. Page No. 2 of 5

¶4It is seen that a Superintendent has already been appointed under Section 25(1)(c) of the Waqf Act, 1995, as amended by the Unified Waqf Management, Empowerment, Efficiency and Development Act, 1995.

¶5Accordingly, this writ petition is disposed of by directing the respondents to facilitate the members of the Jamaat to assemble and conduct the election in accordance with the bylaws of the said Waqf. In the event the election is not conducted in accordance with the bylaws, it is open to the Waqf Board to assume control of the administration of the Waqf and thereafter, conduct the election in accordance with law.
