Judgment

O RDER

This petition is filed under Article 226 of the Constitution of India seeking for a Mandamus to the respondent Police to dispose of the complaint, dated 02.08.2023, filed by the petitioner.

¶2According to the learned counsel for the petitioner, he has been working as a Driver in the Tamil Nadu State Transport Corporation of Tirunelveli District. On 07.07.2023, he was absent from duty, thereby, in respect of that, some altercation place between the petitioner and the Branch Manager and during the course of that, the Branch Manager has abused, threatened and tried to assault him. Basing on which, a complaint is given to the respondent Police, however, no action has been taken.

¶3Learned Government Advocate (Criminal Side) submits that the complaint, dated 02.08.2023 of the petitioner was registered as C.S.R.No.765 of 2023 and summons have been issued on 07.08.2023 and the petitioner though appeared did not give any details stating that, he will talk to his Advocate and then, give all the details.

¶4Considering the submissions made by both sides and on perusal of the records, it appears that the petitioner though filed a complaint before the respondent Police is not interested to get it resolved. In view of the above, the Criminal Original Petition is disposed of, directing the petitioner to appear before the respondent Police on the basis of a summon alleged to have been issued and produce all materials in respect of the allegations against his Branch Manager including the CCTV cameras, on which, the respondent Police are directed to dispose of the same as quickly as possible not later than two weeks from the date of receipt of a copy of this order.
