Judgment

ORDER This Writ Petition is filed for Mandamus forbearing the respondents 3 and 4 from providing electricity connection to the fifth respondent Cell Phone Transmission Tower at R.S.No.119/7 and 8A1, Plot No.1 and 2, Soosai Nagar, 80, Nanji Kottai Village and Taluk, Thanjavur District. At the time of admission, this Court has granted an order of interim injunction.

¶2The petitioner has submitted that the cell phone tower is erected near his residential house and it will affect the health of the persons in and around the tower and hence the petitioner prayed to forbear the respondents from granting electricity connection.

¶3The issue of health hazards by cell phone tower is already settled by the Division Bench of this Court in W.P.(MD)Nos.15974 of 2017 batch dated

29.08.2019. The relevant portion is extracted hereunder:

12.13. In view of the specific stand taken by the Department of Telecommunication and the reports of WHO, there are no materials on record to confirm the existence of any health hazard from exposure to low level electromagnetic field and as stated by the three earlier orders of the different Division Benches of this Court, this Court cannot dwell into those aspects as an expert. Thus, issue No.1 is answered accordingly.

¶4Therefore, following the aforesaid judgment, this Court is not inclined to entertain this Writ Petition. Hence, this Writ Petition is dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
