Judgment

ORDER The petitioner, a convict, was recently released on bail by the Hon'ble Supreme Court by order dated 10.10.2025 in Criminal Appeal No.3089 of 2024. It appears that the petitioner had undergone incarceration for a period of more than 25 years, and therefore, the Hon'ble Supreme Court released the petitioner on bail.

¶2After his release on bail, the petitioner claims to have become aware of certain entries reflected in the Encumbrance Certificate, whereby the petitioner's property is stated to have been conveyed in favour of Sri Visalam Chit Funds Pvt. Ltd., Bengaluru.

¶3It is submitted that the petitioner had not borrowed any money during the period when he was under incarceration. It is further submitted that the alleged borrowers, namely, Kottai Muthu Irulappan, Muthappa Thevar @ Muthupandi, Muthukanamma, Gopalakrishnan, Prema, Vijay, Selvi and Muthu Manikandan, are neither related to the petitioner nor had Page No. 2 of 6 the petitioner authorised them in any manner to offer the petitioner's property situated in Survey No.280/2, measuring an extent of 0.86.5 hectares in Thalaikkattupuram Village, Ettayapuram Taluk, Thoothukudi District, as security.

¶4In this background, the petitioner submitted a representation dated 18.06.2026 seeking alteration of the entries in the Encumbrance Certificate obtained by him for the period from 01.01.1975 to 19.12.2025. Since the same has not been considered so far, the petitioner has approached this Court.

¶5The learned Standing Counsel appearing for the respondents, on the other hand, submitted that the land conveyed in favour of the said Chit Fund Company comprises several survey numbers, including a portion of Survey No.280. It is further submitted that the petitioner may apply for a certified copy of the Sale Certificate from the third respondent and thereafter work out his remedy in accordance with law.

¶6Having considered the submissions made by the learned counsel for the petitioner and the learned Standing Counsel appearing for Page No. 3 of 6 respondents, I am of the view that the wider relief sought for by the petitioner at this stage cannot be granted, particularly, in view of the restrictions contained in Rule 143 of the Registration Rules.

¶7However, it is open to the petitioner to apply for a certified copy of the Sale Certificate and thereafter work out his remedy in the manner known to law. In the event of the petitioner making such an application, the third respondent shall issue a certified copy of the Sale Certificate as expeditiously as possible, preferably, within a period of two weeks from the date of receipt of such application.

¶8With the above liberty, the Writ Petition stands disposed of. There shall be no order as to costs. NCC : Yes / No
