Kanagavalli v. The Registrar of Co-Operative Societies

ORDER The petitioner has submitted representations dated 28.03.2022 and 21.09.2022 to the 5th respondent requesting him to return the jewels and the amount deposited by her husband.

¶2The learned Special Government Pleader appearing for the respondents submits that on verification of records, the 5th respondent found that neither any amount nor any jewels were pledged in the name of the petitioner's husband.

¶3However, the learned counsel appearing for the petitioner claims that the petitioner is having documents to substantiate that her husband has pledged some jewels and deposited some amount with the 5th respondent Society.

¶4Considering the said submissions, this Court directs the petitioner to submit a fresh representation before the second respondent/the Joint Registrar of Co-operative Societies, Palanganatham, Madurai, along with the documents referred to by her, within a period of one week from the date of receipt of a copy of this order. On receipt of such representation, the second respondent/the Joint Registrar of Co-operative Societies, by considering the documents placed by the petitioner, shall conduct an independent enquiry and pass orders within a period of 12 weeks from thereon.

¶5With the above direction, this writ petition is disposed of. No costs.
