Judgment
ORDER This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to consider the petitioner's representation sent through e-mail dated 27.06.2026 and to declare the petitioner (Reg.No.837400, Roll No.20694287) as having passed in all the subjects in the Higher Secondary Examination, 2026, and consequently to issue a corrected consolidated mark sheet.
2.Mr.P.Karthick, learned standing counsel, accepts notice for the first respondent.
3.Since no adverse order is proposed to be passed against the respondents 2 and 3, notice to the respondents 2 and 3 is dispensed with.
4.The learned counsel appearing for the petitioner submitted that the petitioner had passed all the subjects in the Higher Secondary Examination held in March 2025, except Mathematics. After unsuccessfully attempting the compartment examination in July 2025, the petitioner applied as a Private Candidate for the February/March 2026 examination to appear only for the Mathematics paper. Though the online application and the prescribed fee were submitted only for the compartment subject, the respondents erroneously issued a hall ticket containing all five subjects. The petitioner appeared only for the Mathematics examination and successfully cleared the same. However, while publishing the results on 13.05.2026, the respondents incorrectly showed the remaining four subjects as "Absent" with the endorsement "RT", instead of carrying forward the marks already secured in the March 2025 examination and issuing a consolidated mark sheet. Despite submitting several representations seeking rectification of the error, no action has been taken by the respondents. Owing to the erroneous entries, the petitioner has been unable to complete the admission process, despite having secured admission in Dhanalakshmi Srinivasan University. It is further submitted that an earlier writ petition in W.P.(MD) No.19132 of 2026 was dismissed as not maintainable, granting liberty to the petitioner to work out his remedy in the manner known to law. Hence, the present writ petition has been filed.
5.Per contra, Mr.P.Karthick, learned standing counsel appearing for the first respondent, submitted that the petitioner had earlier filed W.P.(MD)No. 19132 of 2026 challenging the proceedings of the first respondent in S.C.No.SSCE/2026/0411291, Reg.No.837400, Roll No.20694287, dated
13.05.2026, insofar as the entries relating to the subjects other than Mathematics were concerned. The said writ petition was listed under the caption "For Maintainability" and came to be dismissed by this Court on
07.07.2026 as not maintainable. He further submitted that the present writ petition has been filed seeking a direction to consider the petitioner's representation and appropriate orders may be passed in accordance with law.
6.Heard the learned counsel appearing for the petitioner and the learned standing counsel appearing for the first respondent.
¶7It is borne out by record and not in dispute that except Mathematics, the petitioner has passed in his first attempt in the other subjects and insofar as Mathematics is concerned, the petitioner appeared in the examination held in February/March 2026 and has come out successful. However, it is the case of the petitioner that while he applied only for Mathematics, the hall ticket has been issued for all the subjects and after passing out Mathematics, in view of the abovesaid error, the other subjects have been shown as absent, though the petitioner has already completed the other subjects and come out successful even in the first attempt.
¶8The aforesaid fact is not disputed by the respondents and such being the case, the mark sheet in the arrear subject issued to the petitioner should only reflect the arrear subject and not all the subjects, as it is the case of the petitioner that he has applied only for appearing in the Mathematics subject. Further, the mark sheet in the initial attempt as well as in the arrears attempt should be read together so as to find out as to whether the petitioner has come out successful.
¶9In the aforesaid circumstances, this Court directs the first respondent to consider the petitioner's representation dated 27.06.2026, in the light of the observations made above and issue mark sheet only for the subject in which the petitioner has appeared in the arrears examination so that the earlier mark sheet and the current arrears mark sheet could be read together to find out as to whether the petitioner has come out successful. However, it is made clear that no consolidated mark sheet could be issued to the petitioner as the separate mark sheets should be read together to assess the successful outcome of the petitioner. The abovesaid exercise shall be carried out by the 1st respondent and a fresh mark sheet for the arrears subject in which the petitioner has appeared alone be issued after verifying the relevant records within a period of four weeks from the date of receipt of a copy of this order.
¶10With the above observations and direction, this Writ Petition stands disposed of. There shall be no order as to costs.
