O R D E R This Writ Petition has been filed for the issue of writ of mandamus directing the respondents to survey and demarcate the plot that was assigned in favour of the petitioner based on the representation dated

16.11.2021.

¶2Heard the learned counsel on either side.

¶3The case of the petitioner is that Plot No.40 was assigned in favour of the petitioner through proceedings of the second respondent dated 14.06.2016. According to the petitioner, the patta and the layout of the house site alone was issued and there was no demarcation on the survey conducted in the house site. The petitioner wanted to construct a house in Plot No.40. Therefore, he made a representation requesting for survey and for demarcation of the boundaries. Since the same was not considered, the present Writ Petition was filed before this Court.

¶4The learned Government Advocate appearing on behalf of the respondents produced the written instructions received from the second respondent. ¶5On going through the written instructions along with the relevant documents, it is seen that as per the proceedings of the second respondent dated 30.04.1994, Plot No.40 was assigned in favour of one Muthubalu son of Kali. The name of the petitioner is K.Muthumari, son of Kalimuthu. In view of this discrepancy, the second respondent is not in a position to survey and demarcate the property as requested by the petitioner.

¶6In view of the same, there shall be a direction to the second respondent to conduct an enquiry and ascertain the actual beneficiary as per the proceedings of the second respondent dated 30.04.1994. If ultimately, the second respondent is able to ascertain that the assignment was made in favour of the petitioner, the request made by the petitioner for survey and demarcation of the boundaries can be carried out. In any case, the decision shall be conveyed to the petitioner by the second respondent within a period of six (6) weeks from the date of receipt of a copy of this order.

¶7This Writ Petition is disposed of with the above directions. No costs.
