Judgment
O R D E R This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents 1, 2, 7 to 10 to consider the petitioner's representation dated 12.06.2026 in accordance with the provision of Rule 20 (2)
(i), (iv) and Rule 3 and Rule 21 (1) of the Tamil Nadu Maintenance of Welfare of Parents and Senior citizens Act, 2007-so as to protect her life and property and to ensure her live with security with dignity.
¶2Heard the learned counsel for the parties.
¶3By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself. Since no adverse order is going to be passed, notice to the respondents 12 to 14 is dispensed with.
¶4The learned counsel for the petitioner submitted that the petitioner's husband passed away in October 2000 and that the petitioner is presently residing in the 12th respondent–Old Age Home. According to the learned counsel, the grievance of the petitioner is that the respondents 13 and 14, who are the petitioner's elder daughter and son-in-law, have failed to take care of her. It is further submitted that the petitioner submitted a representation dated
12.06.2026 seeking the return of her gold jewellery, original ATM cards and the money allegedly withdrawn from her bank account. Since no orders have been passed on the said representation till date, the petitioner has approached this Court seeking a direction to respondents 1, 2 and 7 to 10 to consider and dispose of the said representation within a time frame to be fixed by this Court.
¶5The learned counsel further submitted that it would suffice if this Court issues a direction to the second respondent to consider the petitioner's representation dated 12.06.2026 and pass appropriate orders thereon within a time frame to be fixed by this Court.
¶6Considering the above facts and circumstances of the case and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the second respondent, to consider the representation of the petitioner dated 12.06.2026 and pass appropriate orders on merits and in accordance with law, after affording a reasonable opportunity to the respondents 13 and 14. Such exercise shall be completed as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order. No costs.
