DISPOSED OF
Court
High Court of Madras
Decided

Bench

Case no.
WP Crl.(MD) 4046/2026

Judgment

ORDER This petition has been filed seeking for a direction to the 2nd respondent not to interfere in the civil dispute between the petitioner and the 5th respondent's mother in respect of the property comprised is S.Nos.97/3A1 and 97/3B of Kollankinaru village, Ottapidaram Taluk, Thoothukudi District and consequently direct the 2nd respondent not to harass the petitioner and his father Nagaraju and his paternal uncle Iyyalusamy under the guise of enquiry.

¶2When the matter was taken up for hearing, the learned Government Advocate appearing for the respondent police submitted that the petitioner had appeared before the respondent police and had given a written undertaking stating that the petitioner would resolve the dispute in the pending civil suit in O.S. No. 23 of 2025 on the file of the Sub Court, Thoothukudi.

¶3Heard the learned counsel on either sides and carefully perused the materials placed before this Court. Since no adverse order is proposed to be passed against the fifth respondent, notice to him is dispensed with.

¶4In view of the rival submissions, this Court finds that the respondent police are unnecessarily meddling in a dispute that is already the subject matter of a pending civil suit by issuing notices to the petitioner and requiring his appearance under the guise of conducting an enquiry. Such a course of action is wholly unwarranted. The respondent police are, therefore, directed not to interfere with or meddle in the pending civil dispute in any manner in future, unless warranted by any independent cognizable offence. Accordingly, this Writ Petition stands disposed of.
