¶2The Petitioner is before this Court challenging the Impugned Order passed by the First Respondent/District Collector in his Proceedings dated

¶3By the Impugned Order, the First Respondent has imposed restrictions on the vehicle movement of mineral-laden vehicles passing through Tenkasi District from and to Kerala by restricting the movement between 11.00 p.m. and 3.00 a.m. and between 11.00 a.m. and 4.00 p.m., and fixing norms for the vehicles with odd and even numbers to pass through the roads in alternates.

¶4A reading of the Impugned Order indicates that the Impugned Order has been issued as per the Proviso of Section 115 of the Motor Vehicles Act, 1988.

¶5The learned Additional Advocate General appearing on behalf of the Respondents 1 and 3 submits that the Impugned Order has a short shelf life and it has come to an end on 16.07.2026 as per the Proviso of Section 115 of the Motor Vehilcles Act, 1988.

¶6Considering the same, I direct the Respondents not to impose any restriction pursuant to the Impugned Order unless the Notification is published in the Official Gazatte as is contemplated in the Proviso of Section 115 of the Motor Vehicles Act, 1988.
