Poolan v. The District Collector

O R D E R The petitioner is a farmer and he is having a land in S.No.61/1A, Ponnakarai Village, Kallikudi Revenue Village, Paramakudi Taluk, Ramanathapuram District. The petitioner is also having a water channel from Ponnakarai Kanmoi. In the year 2020, the second respondent has laid a byepass road, connecting Parthibanoor - Kamuthi – Aruppukottai. While executing the work, the water channel, which was in existence in the petitioner's land in S.No.61/1A was damaged. Therefore, now the petitioner is not having any irrigation facilities for his land from Ponnakarai kanmoi. Therefore, the petitioner has approached this Court for a Mandamus to direct the respondents to provide water channel to the petitioner's land.

2.Today(31.08.2023), when this writ petition is taken up for admission, the learned Additional Government Pleader based on the written instructions submits that the third respondent is taking steps to restore the water channel to the petitioner's land in S.No. 61/1A .

3.Recording this undertaking of the third respondent, this writ petition is disposed of with a direction to the third respondent to complete this process as expeditiously as possible preferably within a period of six weeks from the date of receipt of this order. No costs.
