Judgment
O R D E R Mr.M.Dinesh Hari Sudarsan, learned counsel for the Government of Tamil Nadu, takes notice for the respondents 1 & 4 and Mr.S.Vinayak, learned Standing Counsel, takes notice for the respondents 2 & 3.
¶2With the consent of both sides, this writ petition is disposed of at the admission stage.
¶3Heard the learned counsel for the petitioner, learned counsel for the Government of Tamil Nadu appearing for the respondents 1 & 4 and learned Standing Counsel appearing for the respondents 2 & 3.
¶4This writ petition has been filed seeking a writ of certiorarified mandamus calling for the records relating to the impugned order in Na.Ka.No.F7/007654/2025, dated 05.03.2026, on the file of the third respondent, quash the same as illegal and consequently to direct the respondents to sanction and disburse family pension to the petitioner together with all consequential arrears and attendant benefits, by considering the petitioner's representation dated 29.04.2026 within the time stipulated by this Court.
¶5A perusal of the impugned proceedings dated 05.03.2026 issued by the third respondent would disclose that the claim of the petitioner was rejected solely on the ground that the petitioner failed to produce the original death and legal heirship certificates of her deceased father.
¶6Today, when the matter is taken up for consideration for admission, learned counsel for the petitioner submitted that the petitioner has already submitted both the certificates to the respondents, but, the respondents have erroneously rejected the claim of the petitioner on the ground that the original death and legal heirship certificates of her deceased father were not produced. He further submits that the petitioner is ready to produce the said documents once again before the respondents immediately.
¶7Mr.S.Vinayak, learned Standing Counsel appearing for the respondents 2 & 3, fairly submits that in case if the petitioner submits the above said certificates, the case of the petitioner would be considered by the respondents 2 & 3 in accordance with law.
¶8In the light of the above, without going into the merits of the matter, this writ petition is disposed of permitting the petitioner to submit the original death and legal heirship certificates of her deceased father before the respondents 2 & 3 and on submission of the same, the respondents 2 & 3 shall re-consider the case of the petitioner being a widowed daughter of the deceased government servant for grant of family pension and pass appropriate orders thereon, as expeditiously as possible, at any rate within a period of six weeks from the date of submission of the above documents by the petitioner. No costs. Consequently, connected miscellaneous petition is closed.
