However, the National Highways Authority of India has utilized the patta lands and has laid the road. Therefore, the petitioners will be entitled for the compensation. Hence, there shall be a direction to the petitioners to make a claim for compensation before the fourth respondent and the fourth respondent, on receipt of the same, shall conduct an enquiry under Section 3G(3) of the National Highways Act and fix the compensation payable to the petitioners. This process shall be completed by the fourth respondent within a period of three months from the date of receipt of a copy of the representation from the petitioners.
¶4These Writ Petitions are disposed of with the above directions. There shall be no order as to costs.
