BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT ( Criminal Jurisdiction ) Date : 30/07/2026 PRESENT The HONOURABLE MR. JUSTICE K. RAJASEKAR Surendar, S/o.Pitchaimani, No.2/507, Middle Street, Kulathur, Thoothukudi.. ... Petitioner/Accused No.3 Vs The State of Tamilnadu Rep By, The Inspector of Police, Kovilpatti East, Thoothukudi, Cr.No. 569/2026.. ... Respondent/Complainant For Petitioner : Mr.V.Nirmal Kumar, Advocate. For Respondent : Mr.T.Lenin Kumar, Counsel for State of TN (Crl.Side) PETITION FOR BAIL Under Sec.483 of BNSS PRAYER :- C-24B. For Bail in Cr.No.569 of 2026 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner/Accused No.3, who was arrested and remanded to judicial custody on 25.06.2026, for the offences punishable under Section 318(4) of BNS, in Crime No.569 of 2026 on the file of the respondent Police, seeks bail.

¶2The case of the prosecution is that the petitioner, along with A1 and A2, entered into a criminal conspiracy and proceeded to the State of Maharashtra, where they procured counterfeit currency notes. Thereafter, they brought the counterfeit currency to Kovilpatti and, with the assistance of A1 and A2, attempted to circulate the same in the local fish market. However, on suspicion, A1 and A2 were intercepted by the police and arrested. During the course of investigation, 500 counterfeit currency notes of 100 denomination each were recovered from their possession. Based on the confession statements of A1 and A2 and the other materials collected during the investigation, the present petitioner was also arrested.

3.The learned counsel for the petitioner submits that the petitioner is innocent and he was falsely implicated in this case and he is in no way connected in the above said incident. He has not committed any offence as alleged by the prosecution. He further submitted that the petitioner has been in judicial custody from 25.06.2026. He prayed for grant of bail to the petitioner.

4.The learned Counsel for the State of TN (Crl. Side) appearing for the respondent Police reiterated the prosecution case and submitted that this is the second bail application and there is no change in circumstances. He further submitted that the investigation in this case is still pending and no previous case is pending against the petitioner. Hence, he opposed to grant bail to the petitioner.

¶5I have carefully considered the submissions made on either side and perused the materials available on record.

6.Considering the nature of offence and the fact that this Court earlier dismissed the bail application filed by the petitioner in Crl.O.P.

(MD).No.14078 of 2026, vide order dated 13.07.2026 and now the petitioner is in incarceration for more than one month and he is not having any previous case and now all the other accused were arrested, I am inclined to grant bail to the petitioner, subject to the following conditions. [a] Accordingly, the petitioner is ordered to be released on bail on condition to execute a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.1, Kovilpatti, and on further conditions that: [b] the petitioner shall report before the respondent Police daily at 10.30 a.m., for a period of four weeks and thereafter as and when required for interrogation. [c] the petitioner shall not commit any offence similar to the offence of which he/she is accused, or suspected, or of the commission of which he/she is suspected; [d] the petitioner shall not abscond either during investigation or trial; [e] the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such facts to the Court or to any police officer or tamper with the evidence; [f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. [g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
