¶2The case of the prosecution is that the defacto complainant and A1/1st petitioner are husband and wife. At the time of marriage, the first petitioner received 10 sovereigns of fold jewels, Rs.50,000/- as dowry and household articles worth about Rs.1,50,000/-. Subsequently, they harassed the defacto complainant demanding more dowry. Hence, the present case.

¶3The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he was falsely implicated in this case and he has not committed any offence as alleged by the prosecution. He would further submit that this is the second bail application and earlier bail petition filed by the petitioner was dismissed by this Court in Crl.OP(MD)No.113 of 2026 on 16.03.2026 and now, the petitioner filed this petition on the ground there is a change in circumstances and now the investigation was concluded and final report was also filed before the learned Judicial Magistrate, Manapparai, and the same has been taken on file in C.C.No.200 of 2025 and he has been arrested and remanded to judicial custody on 03.06.2026. Therefore, prayed to grant bail for the petitioner.

¶4The learned Government Advocate (Crl.Side) appearing for the respondent and reiterated the prosecution case and on instructions, reported that final report was filed before the learned Judicial Magistrate, Manapparai, and the same has been taken on file in C.C.No.200 of 2025 and the case was posted for appearance of accused.

¶5I have gone through the FIR and also the connected materials.

¶6Considering the rival submissions made by the learned counsel on either side, nature of offence, and considering the facts that final report was filed before the learned Judicial Magistrate, Manapparai, and the same has been taken on file in C.C.No.200 of 2025, and considering the period of incarceration undergone by the petitioner, this Court is inclined to grant bail to the petitioner subject to the following conditions: [a] Accordingly, the petitioner is ordered to be released on bail on condition to execute a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Manapparai, Trichy District, and on further conditions that: [b] the petitioner shall report before the Judicial Magistrate, Manapparai, Trichy District, daily at 10.30 a.m., for a period of 3 weeks and thereafter, as and when required for interrogation. [g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
