For Respondent : Mr.N.Balasubramanian, Counsel For State of TN (Crl.Side) ORDER : The Court made the following order :- The petitioners / Accused, who were arrested and remanded to judicial custody on 03.07.2026 for the offences punishable under Sections 123 and 278 of BNS, 2023, in Crime No.149 of 2026 on the file of the respondent police, seek bail.
¶2The allegation against the petitioners is that the petitioners were found in possession of 17 numbers of Tapendatol Hydrochloride tablets. Hence, the case has been registered and the petitioners have been arrested.
¶3The learned counsel appearing for the petitioners would submit that the petitioners are innocent and they were falsely implicated in this case and they have not committed any offence as alleged by the prosecution. The petitioners are in custody from 03.07.2026 and ready to abide any condition imposed by this Court. Hence, he prayed bail for the petitioners.
¶4The learned Counsel appearing for the State (Crl.Side) reiterated the prosecution case and reported that the first petitioner has 3 previous and the second petitioner has no previous case. He would further submit that the petitioners were found in possession of 17 numbers of Tapendatol Hydrochloride tablets, which were seized along with syringe and saline bottles, which is supposed to be used for intoxication. He opposed the grant of bail to the petitioners.
¶5This Court heard both sides and perused the materials available on record.
¶6Considering the facts and circumstances of the case, considering the nature of offence and it is a case of possession of 17 numbers of Hydrochloride tablets, which is not a scheduled drug under the NDPS Act and though the first petitioner has 3 previous cases, considering the period of incarceration, I am inclined to grant bail to the petitioners subject to certain conditions. [a] Accordingly, the petitioners are ordered to be released on bail on condition to execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.V, Trichy, and on further conditions that: [b] the petitioners shall report before the Judicial Magistrate No.V, Trichy, daily at at 10.30 a.m., for a period of 4 weeks and thereafter as and when required for interrogation. [g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
