Judgment
ORDER Mr.R.Parthiban, learned Counsel for State of TN, takes notice for the respondents 1 and 2.
2.This Writ Petition is taken up for final hearing at the time of admission with the consent of the learned counsel for the petitioner and learned Counsel for State of TN for the respondents 1 and 2, after dispensing with the counter and notice on the private respondent/4th respondent, who appears to be the petitioner's neighbour, as no adverse orders are proposed to be passed against him.
¶3This Writ Petition has been filed for a Mandamus directing respondents, more particularly, the second respondent to consider the petitioner's representation dated 07.07.2026 and pass appropriate orders on merit and in accordance with law in relation to the usage of Alangulam Town Panchayat pathway.
¶4It is the case of the petitioner that the petitioner's neighbour, namely, the 4th respondent is obstructing the usage of Panchayat pathway and therefore, the petitioner has given a representation dated 07.07.2026 to the second respondent/Tahsildar. However, it does not evade any response.
¶5The learned Counsel for State of TN for the respondents 1 and 2 submits that the aforesaid representation of the petitioner dated 07.07.2026 will be considered and disposed of on merits. However, it is reported that the aforesaid representation has not been received by the second respondent.
¶6Since a copy of the representation is reportedly not available with the office of the second respondent, the petitioner is directed to serve a fresh copy of the same within a period of one (1) week from today.
¶7The second respondent shall consider the petitioner's representation dated 07.07.2026 and disposed of the same on merits and in accordance with law within a period of four (4) weeks from the date of receipt of a copy of the said representation. Needless to state, before passing such order, the private respondent/4th respondent shall also be heard.
¶8This Writ Petition is disposed of, with the above observations. No costs. Consequently, connected miscellaneous petition is closed. Index : Yes / No
