Judgment

ORDER The present petition has been filed by the revision petitioner in Crl.R.C.No.12 of 2025 on the file of Principal District in Sessions Court, Pudukkottai seeking to set aside the conditions imposed by the concerned Court for interim custody of the weapon that was seized in Cr.No.451 of 2021 on the file of the Keeranur Police Station / second respondent.

2.According to the learned counsel appearing for the petitioner, the petitioner is an Inspector of Police working in CISF at International Airport Trichy. At the time of training due to some mistake, the gun caught triggered and the bullet had caused death to a boy. Therefore, FIR was registered in Crime No.451 of 2021 on the file of the second respondent police under Sections 286 and 304(A) of IPC.

3.The learned counsel appearing for the petitioner further submits that the respondent police has filed an RCS report in RCS No.6 of 2024. In such circumstances, the petitioner had filed a petition in Crl.M.P.No 1106 of 2024 seeking interim custody of the weapon. However, the said application was dismissed by the trial Court on 21.10.2024 on the ground that the weapon might have been involved in the offence. Challenging the same, the petitioner had preferred revision in Crl.R.C.No.12 of 2025 before the Principal District and Sessions Court, Pudukkottai. The revision Court was pleased to allow the revision; however, had imposed several conditions upon the petitioner. Especially in the condition No.1, the petitioner has been directed to execute a own bond for a sum of Rs.1,00,000/-.

4.According to the learned counsel appearing for the petitioner, the weapon is the property of CISF and in such circumstances, the petitioner should not be directed to execute a own bond. He further submits that when the police have already filed RCS report, the question of imposing stringent conditions upon the petitioner would not arise.

5.Heard the learned counsel appearing for the petitioner and perused the materials available on record.

6.Considering the fact that the weapon belongs to CISF and already the police officials have filed RCS report, I hereby set aside the conditions imposed in Crl.R.C.No.12 of 2025, dated 29.08.2025 passed by the learned Principal District and Sessions Judge, Pudukkottai and the concerned authorities are directed to grant custody of the weapon to the petitioner herein.

7.With the aforesaid observations, this Criminal Original Petition stands allowed. Consequently, connected miscellaneous petition is allowed.
