Judgment

O R D E R [Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] This writ petition has been filed seeking a Writ of Certiorarified Mandamus to call for the records of the Impugned order dated 17.04.2026 in No.404/U.Tha.2/2026 passed by the 2nd respondent, quash the same and consequently direct the respondents to grant ordinary leave without police escort to the petitioner namely Michael Muniyandi @ Page No.2 of 6 Muniyandisamy son of Pandi (PID No.22750), aged about 37 years, confined at Central Prison, Madurai.

¶2The learned counsel for the petitioner would submit that the petitioner is a convict prisoner had sought for 21 days ordinary leave whereas the respondents have rejected the same, thereby the present writ petition has been failed.

¶3Mr.D.Venkatesh, learned counsel for the State of Tamil Nadu appearing for the respondents would submit that the convict prisoner is facing four (4) pending cases against him and thereby, he is not eligible for ordinary leave as per Rule 35 of the Tamil Nadu Suspension of Sentence Rules. Therefore, the 2nd respondent has rejected the request of the petitioner vide impugned order, which does not warrant interference by this Court.

¶4Taking into consideration of the fact that 4 cases pending against the convict prisoner and Rule 35 of the Tamil Nadu Suspension of Sentence Rules, prohibits grant of ordinary leave to the convict prisoner, we do not find any infirmity in the impugned order. Page No.3 of 6

¶5Accordingly, this writ petition is dismissed. No costs. [A.D.J.C., J.] [R.P., J.]
