Judgment

BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT ( Criminal Jurisdiction ) Date : 27.07.2026 PRESENT THE HONOURABLE MR.JUSTICE K. RAJASEKAR CRL OP(MD)No.15504 of 2026 S.Siva ... Petitioner / Accused No.1

Versus The State of Tamil Nadu, Rep by the Inspector of Police, Austinpatti Police Station, Madurai District. (Crime No.153 of 2026) ... Respondent/Complainant PRAYER :-Criminal Original Petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking to enlarge the petitioner on bail in the event of arrest in Crime No.153 of 2026 on the file of the respondent police, or on his appearance. For Petitioner : Mr.S.Saasan Kumar

For Respondent : Mr.N.Balasubramanian, Counsel for State of TN (Criminal Side) ORDER : The Court made the following order :- The petitioner, who apprehends arrest in connection with Crime No.153 of 2026 on the file of the respondent police, registered for the offences punishable under Sections 296(b), 118(1) and 351(3) of the Bharatiya Nyaya Sanhita, 2023, seeks anticipatory bail.

¶2The case of the prosecution is that, owing to an earlier occurrence between the parties, cases had already been registered against both the petitioner and the defacto complainant. It is alleged that, harbouring a grudge over the earlier incident, the petitioner once again waylaid the defacto complainant, attacked him with a wooden log, and caused injuries. Thereafter, the defacto complainant was admitted to the hospital, and upon his complaint, the present case came to be registered.

¶3The learned counsel for the petitioner submitted that, owing to previous enmity, the petitioner has been falsely implicated in the present case. He further submitted that the petitioner is ready and willing to cooperate with the investigation and that the injured has already been discharged from the hospital. Hence, he prayed for the grant of anticipatory bail.

¶4Per contra, the learned Counsel for State (Criminal Side) reiterated the prosecution case and submitted that, although the injured has been discharged from the hospital, the present occurrence is the second incident involving the same parties and the petitioner has repeatedly attacked the defacto complainant. He therefore opposed the grant of anticipatory bail.

¶5This Court has carefully considered the rival submissions and perused the materials available on record.

¶6Considering the nature and gravity of the allegations, the motive attributed to the petitioner, and the fact that the present occurrence is the second incident involving the same parties, this Court is of the view that, if the petitioner is granted anticipatory bail, there is every likelihood of his indulging in similar offences or interfering with the investigation. Accordingly, this Court is not inclined to grant the extraordinary relief of anticipatory bail. Hence, this Criminal Original Petition stands dismissed.
