Judgment
O R D E R The present Writ Petition has been filed by a pensioner seeking a Mandamus as against the respondents to reimburse a sum of Rs.8,00,000/- along with 12% interest for the medical treatment taken by him.
¶2The petitioner had met with an accident on 13.10.2016 and he was admitted to Devadhas Multi Speciality Hospital, Madurai, wherein he had availed the facility of cashless treatment and a sum of Rs.2,00,000/- has been paid by the third respondent Insurance Company. Since the balance amount has not been paid, the present writ petition has been filed.
¶3According to the learned Standing Counsel appearing for the third respondent, the petitioner being a pensioner is governed by G.O.(Ms) No.171, Finance (Pension) Department, dated 26.06.2014. As per clause 7, for a block period of four years from 01.07.2014 to 30.06.2018, the pensioner would be entitled for a cashless treatment upto Rs.2,00,000/-. Since the said amount has already been paid to the hospital, in which, the petitioner has undergone treatment, no further amount would be paid by the Insurance Company. Whatever the petitioner is eligible under the Government Scheme, has already been released by the third respondent/Insurance Company.
¶4In view of the above said facts, a Mandamus cannot be issued as against the third respondent. It is for the petitioners to approach the competent Court under Motor Accidents Claims Tribunal for recovering balance amount seeking compensation, if he is so advised.
¶5With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs.
