For Respondent : Mr.N.Balasubramanian Counsel for State of TN (Crl. Side) PETITION FOR BAIL Under Sec.483 of BNSS PRAYER :- For Bail in Cr.No. 206 of 2026 on the file of the respondent police. ORDER : The Court made the following order :- The petitioners / Accused, who was arrested and remanded to judicial custody on 17.07.2026 for the offences punishable under Sections 326(g), 324(4) of BNS @ to Sections 191(2), 324(2) and 326(g) of BNS, in Crime No. 206 of 2026 on the file of the respondent police, seeks bail.

¶2The case of the prosecution is that due to previous enmity between the parties, the petitioners joining hands with other accused hurled a Molotov cocktail on the house of the defacto complainant, which resulted in causing threat on the minds of the defacto complainant and also caused damages worth about Rs.5,000/-. Hence, the case.

¶3The learned counsel appearing for the petitioners would submit that the petitioners are innocent and they were falsely implicated in this case and they have not committed any offence as alleged by the prosecution. The petitioners are in custody from 17.07.2026 and ready to abide any condition imposed by this Court. The petitioners have no previous case and they are all young age. Hence, he prayed bail for the petitioners.

¶4The learned Counsel appearing for the State reiterated the prosecution case and reported that the petitioners have no previous cases except the third petitioner. The third petitioner has one previous case. No one was injured in this case. Investigation in this case is still pending. Hence, he prays to dismiss this application.

¶5This Court heard both sides and perused the materials available on record.

¶6Considering the facts and circumstances of the case, though the third petitioner has one previous case, it is only for other IPC offence and all other petitioners have no previous case and considering the period of incarceration, I am inclined to grant bail to the petitioners on condition of payment. [a] Accordingly, this Criminal Original Petition is allowed on condition that the petitioners shall deposit a sum of Rs.1,500/- (Rupees one thousand five hundred only) each to the credit of Cr.No. 206 of 2026 before the trial Court concerned, without prejudice to their rights and contentions before the trial Court.
