Judgment

O R D E R This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the second respondent to consider, conduct enquiry and pass order on the petitioners representation dated 08.04.2026 given under the maintenance and Welfare of Parents and Senior Citizens Act 2007 against the 3rd respondent within a stipulated time.

¶2Heard the learned counsel for the parties.

¶3By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself. Since no adverse order is going to be passed, notice to the third respondent is dispensed with.

¶4The petitioner, a 77-year-old senior citizen, alleges that she is facing an imminent threat and physical harassment at the hands of the third respondent, who is none other than her son, with an attempt to forcibly evict her from the house. It is further alleged that the third respondent has occupied the first floor of the house without the petitioner's consent. In this regard, the petitioner submitted a representation dated 08.04.2026 to the respondents, requesting them to take appropriate action against the third respondent. It is submitted that, despite receipt of the said representation, the respondents have not taken any action thereon. Aggrieved by the inaction on the part of the respondents, the petitioner has filed the present Writ Petition.

¶5The learned counsel further submitted that it would suffice if this Court issues a direction to the first respondent to consider the petitioner's representation dated 08.04.2026 and pass appropriate orders thereon within a time frame to be fixed by this Court.

¶6Considering the above facts and circumstances of the case and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to consider the representation of the petitioner dated 08.04.2026 and pass appropriate orders on merits and in accordance with law, after providing a reasonable opportunity to the third respondent. Such exercise shall be completed as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order. No costs.
