Judgment

O R D E R This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents herein to conduct the third respondent society election for the triennium 2025-2028 as per its bylaws within the time stipulated by this Honble Court in light of the Orders passed by this Honble Court vide its Order dated 20.06.2022 and 10.08.2022 in WP (MD) No.10377 and 10965 of 2022 and WA (MD) Nos.632-635 of 2022 respectively, by considering the petitioners representation dated 02.04.2026.

¶2Heard the learned counsel for the parties.

¶3By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself. Since no adverse order is going to be passed, notice to the third respondent is dispensed with.

¶4The learned counsel appearing for the petitioner submitted that the petitioner had submitted a representation dated 02.04.2026 requesting the respondents to conduct the election to the third respondent Society for the triennium 2025–2028 in accordance with its bye-laws. It is further submitted that despite the earlier orders passed by this Court, no steps have been taken by the respondents to conduct the election. Since the petitioner's representation has not been considered till date, the petitioner has approached this Court by way of filing the present writ petition.

¶5The learned counsel further submitted that it would suffice if this Court issues a direction to the second respondent to consider the petitioner's representation dated 02.04.2026 and pass appropriate orders thereon within a time frame to be fixed by this Court.

¶6Considering the above facts and circumstances of the case and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the second respondent to consider the representation of the petitioner dated 02.04.2026 and pass appropriate orders on merits and in accordance with law, after providing an opportunity of hearing to the third respondent. Such exercise shall be completed as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order. No costs.
