Case no.
WP(MD) 21776/2026

Judgment

O R D E R The present Writ Petition has been filed seeking for a direction to the official respondents to forbear the respondents 4 & 5 herein from in any manner interfering with the execution of work of petitioner as per proceedings of third respondent in Na.Ka.B2/2843/2025 dated 13.02.2026, by considering the representation given by the petitioner on 16.07.2026.

2.Learned Counsel for the petitioner would submit that the petitioner is enjoying a Nilaviyal Odai, running in Survey No.971/1A1, which is a government poramboke land. Since the petitioner's land is landlocked, the petitioner made representation before the official respondents for construction of a small bridge across the Odai. The first respondent, on verification of the petitioner's right to access which is available only across the water channel / Odai, has granted permission, however, with certain conditions to put up a small bridge across the said Odai, vide order dated

13.02.2026. However, the respondents 4 & 5 have objected to the commencement of the bridge construction work. Thereby, the petitioner made a representation to the official respondents on 16.07.2026, which remains unconsidered till date. Hence, the present Writ Petition.

3.Learned Special Government Pleader appearing for the official respondents would submit that the third respondent is not the competent authority to grant permission based on the request of the petitioner. The petitioner has to approach the jurisdictional revenue officials for redressal of his grievance.

4.In response, learned Counsel for the petitioner would submit that this Court may grant liberty to the petitioner to make appropriate application before the jurisdictional revenue officials for redressal of his grievance.

5.Heard the learned Counsel for the parties.

6.Considering the request made by the learned Counsel for the petitioner, this Writ Petition is disposed of, without going into the merits of the matter, however, granting liberty to the petitioner to make appropriate application before the revenue officials for redressal of his grievance. The authority concerned shall pass appropriate orders in accordance with law, after providing opportunity to the private respondents. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
