Judgment
O R D E R This writ petition has been filed challenging the impugned proceedings dated 30.06.2026, issued by the first respondent, whereby the petitioner was placed under suspension pending initiation of disciplinary proceedings.
¶2Learned counsel for the petitioner contends that on an earlier occasion, the respondents placed the petitioner under suspension vide order dated 22.08.2024 and the said suspension order has been set aside by this Court vide order dated 05.01.2026 in W.P.(MD) No.20886 of 2024. But, despite the same, the respondents have, once again, issued the impugned suspension order basing on the very same allegations. He also further submits that all the allegations levelled against the petitioner are false and the petitioner cannot be made liable for all such allegations.
¶3This Court, having considered the submissions made by the learned counsel for the petitioner and also perused the materials on record, is of the considered view that this is not a fit case, where this Court can interfere with the impugned order of suspension. Earlier, the order of suspension dated 22.08.2024 was interfered with by this Court only on the ground that the same was passed by an incompetent authority. This Court has never gone into the merits of the matter. Therefore, it is totally irrelevant to say that on the very same allegations, the impugned order of suspension cannot be issued. A perusal of the impugned proceedings discloses that the same has been issued by the Common Cadre Authority, which is the competent authority to place the petitioner under suspension. In the circumstances, this Court is not inclined to interfere with the impugned suspension as the same is of recent origin.
¶4Accordingly, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
