Case no.
WP(MD) 22657/2023

Judgment

O R D E R Assailing the order dated 20.07.2023 passed by the first respondent, whereby the first respondent refused to cancel the settlement deed executed by the petitioner in favour of the respondents 3 to 5, the present writ petition has been filed.

¶2The learned counsel appearing for the petitioner would submit that the petitioner had preferred a complaint before the second respondent under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, seeking maintenance from the private respondents 3 to 5, who are the petitioner's grandsons. The original authority, after considering the materials on record, directed each of the private respondents to pay monthly maintenance of Rs.2,000 to the petitioner. Seeking enhancement of the maintenance amount, the petitioner preferred an appeal before the first respondent. The first respondent, however, confirmed the order passed by the second respondent. Aggrieved thereby, the present writ petition has been filed.

¶3At the time of hearing, the learned counsel for the petitioner, without pressing the challenge on merits, submitted that this Court may issue a direction to the official respondents to ensure that the maintenance amount awarded is regularly paid by the private respondents, since they have failed to comply with the order.

¶4Per contra, the learned counsel appearing for the private respondents 3 to 5 would submit that the maintenance amount is being paid regularly to the petitioner.

¶5In view of the above submissions, this Court directs the first and second respondents to ensure that the maintenance amount awarded is paid to the petitioner by the private respondents 3 to 5, if not already paid, within a period of four weeks from the date of receipt of a copy of this order. Accordingly, the writ petition stands disposed of. No costs.
