Judgment

O R D E R This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents to calculate the outstanding amount payable in respect of Loan No. NFS-103 dated 31.03.2000, permit the petitioners to settle the liability under the One Time Settlement (OTS) Scheme, and consequently cancel the mortgage deed registered as Document No.1750 of 2000 dated 31.03.2000 by considering the petitioners' representation dated 17.07.2026 within a time frame to be fixed by this Court.

¶2Heard Mr.S.Sivakumar, learned counsel appearing for the petitioners and Mr.R.Ramasamy, learned counsel for State, who takes notice on behalf of the respondents.

¶3By consent of both parties, this Writ Petition is taken up for final disposal at the admission stage itself.

¶4The learned counsel appearing for the petitioners submitted that the petitioners had submitted a representation dated 17.07.2026 to the respondents requesting them to calculate the outstanding amount payable in respect of Loan No. NFS-103 dated 31.03.2000, permit the petitioners to settle the liability under the One Time Settlement (OTS) Scheme, and thereafter cancel the mortgage deed registered as Document No.1750 of 2000 dated 31.03.2000. According to the learned counsel, despite the submission of the said representation, the same has not been considered by the respondents till date. Left with no other efficacious remedy, the petitioners have approached this Court by filing the present Writ Petition.

¶5The learned counsel for the petitioners further submitted that, without going into the merits of the petitioners' claim, it would suffice if this Court issues a direction to the second respondent to consider the petitioners' representation dated 17.07.2026 and pass appropriate orders within a time frame to be fixed by this Court.

¶6The learned counsel for State appearing for the respondents has no serious objection to such a direction being issued.

¶7Considering the facts and circumstances of the case, and without expressing any opinion on the merits of the petitioners' claim, this Writ Petition is disposed of with a direction to the second respondent to consider the petitioners' representation dated 17.07.2026 seeking settlement of the loan account under the One Time Settlement (OTS) Scheme and pass appropriate orders on merits and in accordance with law. Such exercise shall be completed as expeditiously as possible, preferably within a period of four (4) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
